Delhi High Court upholds closure of Kendriya Vidyalaya NTPC Badarpur is against society’s interests

The Delhi High Court on Thursday ordered administrators to make sure the Kendriya Vidyalaya NTPC in Badarpur stays operational, observing that closing the school on the grounds that the nearby power plant had been shut down would be against society’s best interests.

According to a bench led by Chief Justice Satish Chandra Sharma, NTPC, which is owned and operated by the government, will continue to provide funding for the neighbourhood school until a committee headed by the lieutenant governor of Delhi finds a solution.

The court anticipates that the committee will find a solution to prevent the closure of the school, which has been open since 1981.

It goes without saying that NTPC will continue paying the disputed school until a solution is found, declared the bench, which also included Justice Saneev Narula.

The committee will also include the LG, the chief secretary (who will serve as the nodal officer), the commissioner of the Kendriya Vidyalaya Sangathan, a representative of the relevant ministry, parents’ and teachers’ organisation representatives, and the NTPC, according to the court.

In response to a PIL filed by the NGO Social Jurist challenging the purported closure of Kendriya Vidyalaya NTPC Badarpur, the court issued its ruling. The court had already ordered the relevant authorities to refrain from closing the institution.

The children of the officers who worked there were no longer enrolled in the school when the power plant shut down five years ago, and even the site had been given to the Centre, according to information provided to the court during the hearing.

The court stated that the school cannot be closed because students from nearby neighbourhoods were enrolled there, and NTPC cannot request its closure. These villagers are indigent. The school cannot be closed. Please continue to support it.The court noted that closing a school on this justification would be bad for society as a whole.

Chetan Sharma, the additional solicitor general, advised that the LG might call a meeting of the relevant authorities to look into the matter. The petitioner NGO has complained to the court that the administration is considering closing the Kendriya Vidyalaya NTPC Badarpur, which would have a severe negative effect on the school’s kids and the aspirants living nearby.

According to the petitioner, who is being represented by attorney Ashok Agarwal, closing the school would be against both the provisions of the Right of Children to Free and Compulsory Education Act 2009 and the fundamental right to education guaranteed to students. The school was founded in 1981–1982 and was operating as a project funded by the NTPC.
