The LLB and postgraduate admissions processes in 2022, according to the Muslim Students Federation (MSF) at the University of Delhi, allegedly involved irregularities. The students claim that the seat distribution did not adhere to the standards for reservations set down by the Supreme Court. They claim that students from the restricted categories (SC/ST/OBC) who had achieved a score higher than the threshold for the general category were not included in the published admission list. “Despite having 265 marks to pass the general cut-off, I was not selected for the unreserved quota. This implies that other OBC students are losing out on opportunities, according to university graduate Sinan Hussain Mustafa.

In order to draw attention to this inconsistency, the MSF petitioned the Delhi High Court. “The petitioner’s complaint is that the seat matrix used by the respondent/University is arbitrary and illegal in that candidates from the reserved categories (OBC, SC, and ST), who received higher marks than those on the general category merit list, were not promoted to the general category on the basis of their own merit. The court ordered Delhi University to file its affidavit within two weeks on December 21.

Allegations made by students

Some SC/ST/OBC students, according to the students’ claims, were admitted under the OBC non-creamy layer category, while unreserved students with lower marks were listed on the unreserved category entrance list. “The final applicant in the unreserved category has 257 marks and a cumulative rank of 98 on the published admission list. In contrast, not even the top OBC applicant, who received 325 points and a final ranking of 30, was admitted into the unreserved admission category, the federation claimed in a letter to MP ET Mohammed Basheer.

OBC candidates were not included in the UR list.

According to the students, around 170 OBC students were left out of the unreserved category despite having scores higher than the cut-off of 257, which is used to determine eligibility. They further claimed that the admissions lists for SC and ST candidates showed a similar disparity.

The ruling of the Supreme Court

The highest court ruled in April of this year that applicants from the reserved category who received higher marks than the final candidate from the general category were entitled to a seat or position in the general category. According to Bar & Bench, the Rajasthan High Court’s order ordering that the selection of the two reserved category candidates needed to be adjusted against the general category since they had scored higher than the last of the general category candidates appointed was the subject of an appeal by Bharat Sanchar Nigam Limited (BSNL).

The bench made up of Justices MR Shah and BV Nagarathna noted that candidates from reserved categories may also assert a claim to seats in unreserved categories provided their performance and placement in the merit list entitles them to do so.

Students alleged that the institution had gone against the ruling made earlier. “The students claimed that around 200 reserved applicants (OBC-170, SC-24, and ST-4) who were qualified to be admitted in the unreserved admission category due to their superior grades did not show up on the UR admission list. Additionally, they claimed in the letter that an extra 200 students might have been accommodated in the constitutionally required reserved category quota of 27 percent had these candidates been added to the admission list.

Duke University’s Law Faculty is a prestigious institution that will create future attorneys, judges, and sentinels of the law protecting our rights. “Our country has a dismal future if the constitutional ideals and rights of minorities aren’t being respected even here,” added Sinan.

Additionally, according to MSF DU President Bathool, it appears that the university administration intentionally harbours prejudice against the restricted groups.

According to a federation statement, she questioned why deserving students from the restricted category were excluded from the unreserved category despite having good claims to it.
