The National Medical Commission (NMC) Act of 2019 has been suggested for revision by the Indian Ministry of Health and Family Welfare. The suggested draught revisions have been made available for public comment and criticism. The creation of the Board of Examinations in Medical Sciences (BEMS), which will be established in accordance with Section 16 of the NMC Act, is a significant aspect of these reforms. The National Exit Test (NEXT), as well as exit tests for the Diploma, Diplomate and Fellowship postgraduate and Diplomate and Fellowship super-speciality medical degrees, will be administered by the BEMS in place of the National Board of Examination in Medical Sciences. The National Board for Educational and Medical Services (NBEMS), an independent agency under the Ministry of Health and Family Welfare, used to administer the Diplomat National Board Post Diploma Centralized Entrance Test (DNB PDCET) and the National Eligibility-cum-Entrance Test Postgraduate (NEET PG) for admissions into postgraduate medical programmes.

The Foreign Medical Graduate Examination, a screening test for foreign medical graduates wishing to practise medicine in India, was also administered by the NBEMS (FMGE). The National Exit Test, which will be the sole licence and admission exam for MBBS graduates to register in the National and State medical registers and qualify for PG medical courses in the nation, will now replace the FMGE and NEET PG. The newly established Board of Examinations in Medical Sciences within the NMC will now administer the NEXT test, which is slated to take place in December 2023. In December 2022, the NMC released the draught regulations for the NEXT test for evaluation by the general public after it was first suggested as part of the NMC Act in 2019.

The NMC has also stated that the BEMS will have the authority to establish minimum standards for medical universities to conduct exams for Diploma, Diplomate and Fellowship postgraduate and Diplomate and Fellowship super-speciality courses, and to accredit them for the same. This is included in the draught regulations for the BEMS. For these courses, the BEMS will also oversee the exit exams and award degrees. The BEMS is authorised to conduct any examination of any medical institution as mandated by the NMC or the Central government in addition to NEXT and the Diploma and Fellowship exams.

In addition to the rules for the BEMS, the NBEMS was also suggested to be disbanded in the new draught regulations to the NMC Act (2019). Up until the order’s expiration, any medical institute accredited by the NBEMS to deliver Diploma courses or tests is permitted to do so. Similar to this, any regulations created by the NBEMS shall remain in effect up until the Commission modifies them. Additionally, the NBEMS will transfer to the NMC all subsidiaries, owned trusts, assets, and obligations.

The proposed laws further stipulate that any legal action taken by any medical institution in the nation against the NMC or the national government shall be brought before the Delhi High Court.
